TopTubs Total Care (Effective Date: 27 December 2024)
SUBSCRIPTION AGREEMENT - TOPTUBS TOTAL CARE
This Subscription Agreement ("Agreement") is made between Jason Bagg T/A TopTubs Grimsby ("we", "us", or "our"), a self-employed individual based in the UK with a home address at 13 Osbourne Drive, Grimsby, Holton-Le-Clay, DN36 5DP, and you ("you" or "your"), the customer subscribing to our TopTubs Total Care service. By subscribing to our TopTubs Total Care service, you agree to be bound by the terms and conditions of this Agreement.
1. Description of TopTubs Total Care Subscription Our TopTubs Total Care Subscription is a weekly subscription service that provides hot tub maintenance to customers located within a 10-mile radius of DN36 5BU, UK. The service includes one visit per week, covering tasks such as cleaning, water balancing, sanitisation, and equipment checks. The weekly subscription fee is £10.00, charged until cancellation.
TopTubs Monthly Bronze (Effective Date: 27 December 2024)
SUBSCRIPTION AGREEMENT - TOPTUBS MONTHLY BRONZE
This Subscription Agreement is made between Jason Bagg T/A TopTubs Grimsby and you, the customer subscribing to our TopTubs Monthly Bronze service. By subscribing to this service, you acknowledge the monthly fee of £9.99 and agree to receive discounts on specified services while the subscription is active.
Hot Tub Sales Terms and Conditions (Effective Date: 27 December 2024)
SALES AGREEMENT - HOT TUB PURCHASE
This Sales Agreement ("Agreement") is made between Jason Bagg T/A TopTubs Grimsby ("we", "us", or "our") and you ("you" or "your"), the customer purchasing a hot tub from us. By completing a hot tub purchase, you agree to these terms:
1. Order Placement and Payment 1.1. Full payment or an agreed deposit is required at checkout to secure your order. 1.2. Any outstanding balance must be paid prior to delivery. 1.3. Payment methods include credit card, bank transfer, or financing options where available. 1.4. Any changes to the order after confirmation may incur additional fees, which will be communicated and agreed upon in advance.
2. Delivery and Installation 2.1. We offer free delivery within a [radius] mile radius of DN36 5BU. Delivery beyond this radius may incur additional charges (£X per additional mile). 2.2. If delivery cannot be completed due to inadequate site preparation, rescheduling will incur a redelivery fee of £250. 2.3. Customers must ensure the delivery site is level, stable, and free from obstructions. 2.4. If crane hire or other specialist equipment is required for delivery, additional charges will apply and must be agreed upon prior to delivery. 2.5. Installation includes placement, connection to the power supply, initial filling, and testing. The customer must ensure the power supply is ready and accessible. 2.6. If water supply is not available on-site, customers must notify us in advance to arrange alternative provisions.
3. Pre-Delivery Checklist 3.1. Customers must confirm:
Surface is level and stable (e.g., patio, decking).
Access paths meet delivery requirements (minimum 1m width).
Overhead obstructions (e.g., trees, awnings) are cleared.
Power supply (13A plug-and-play or 32A hard-wired) is prepared. 3.2. Failure to meet these requirements may result in delivery rescheduling and additional charges.
4. Warranty and Returns 4.1. Hot tubs come with a [warranty period] warranty covering manufacturing defects. 4.2. Warranty excludes:
Damage due to misuse, improper maintenance, or external factors (e.g., weather, flooding).
Consumables such as filters and chemicals. 4.3. Returns are accepted within 14 days of delivery if the hot tub remains unused and in its original packaging. Return shipping costs are the customer’s responsibility. 4.4. Refunds will be processed within 14 days of receiving the returned item, subject to inspection.
5. Limitation of Liability 5.1. We are not responsible for damages arising from improper installation by authorised individuals, unprepared sites, or external factors beyond our control. 5.2. Our liability is limited to the purchase price of the hot tub. 5.3. In cases of force delay (e.g., extreme weather, supply chain delays), delivery or installation may be rescheduled without liability.
6. Force Delay Clause 6.1. We are not liable for failure to perform any obligations due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or supplier delays. 6.2. Customers will be informed promptly of any delays or rescheduling caused by such events.
7. Post-Sale Support 7.1. We offer ongoing maintenance and service plans for purchase. 7.2. Customers are encouraged to contact us for troubleshooting and care advice. 7.3. A complimentary follow-up call or email will be made within 7 days of installation to address any initial concerns or questions.
8. Confidentiality and Data Protection 8.1. We will handle your personal information in compliance with applicable data protection laws. Details provided will only be used for completing and managing your order.
9. Governing Law and Jurisdiction 9.1. This Agreement is governed by the laws of England and Wales. 9.2. Any disputes arising under this Agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Customer Acknowledgment By purchasing a hot tub, you confirm that you have read and understood these terms and agree to abide by them.
General Terms for All Agreements
1. Notices All notices required under these Agreements must be provided in writing via email or certified mail. Notices are deemed effective upon delivery.
2. Changes to Terms We reserve the right to update these terms at any time. Updated terms will be posted on our website, and continued use of our services will constitute acceptance of the changes.
3. Entire Agreement These terms represent the entire agreement between the customer and TopTubs Grimsby and supersede all prior agreements, understandings, or representations.

SUBSCRIPTION AGREEMENT - TOPTUBS MONTHLY BRONZE
This Subscription Agreement ("Agreement") is made between Jason Bagg T/A TopTubs Grimsby ("we", "us", or "our"), a self-employed individual based in the UK with a home address at 28 Newstead Avenue, Grimsby, Holton-Le-Clay, DN36 5BU, and you ("you" or "your"), the customer subscribing to our TopTubs Total Care service. By subscribing to our TopTubs Monthly Bronze service, you agree to be bound by the terms and conditions of this Agreement.
Description of TopTubs Monthly Bronze Subscription
Our TopTubs Monthly Bronze Subscription is a monthly subscription service that provides customers located within a 50-mile radius of DN36 5BU, UK access to discounts on our other services. The subscription does not include a weekly visit or any hot tub maintenance services. By subscribing, you acknowledge and agree that you are entitled to the following discounts on our other services while the subscription is active:
Platinum Annual Service: 20% OFF
Wake Up/Shut Down: 33% OFF
Water Changes: 25% OFF
Call-outs: 50% OFF
Repairs: 10% Discount Applied
You acknowledge and agree that this is a subscription-based service, and you will be charged a monthly fee of £9.99. This fee will be charged monthly until you cancel the subscription. You may cancel the subscription at any time by giving written notice to us. We reserve the right to cancel the subscription at any time, in our sole discretion, upon giving you written notice.
2. Eligibility for TopTubs Monthly Bronze Subscription
To be eligible for the TopTubs Total Care Subscription, you must have previously received one of the following services from us: Platinum Annual Service, Start Up, Shut Down, Water Change, or Call-out, and you must provide us with proof of the service(s) rendered. By subscribing, you represent and warrant that the hot tub is in proper working order and that there are no existing mechanical, electrical, or other issues that could impede our ability to provide maintenance services. You agree to notify us promptly if any such issues arise during the subscription term. You acknowledge and agree that any necessary repairs or replacements required to make the hot tub operable must be completed prior to the start of the subscription, and that any additional repairs or replacements required during the subscription term will be subject to additional fees. We reserve the right to terminate the subscription at any time, in our sole discretion, if we determine that the hot tub is not in proper working order or if any necessary repairs or replacements have not been completed.
3. Subscription Fees and Payment
The subscription fee for TopTubs Monthly Bronze Subscription is £9.99 per month, charged monthly. Payment is due each month and may be made by credit card, bank transfer, or cash. We reserve the right to change the subscription fee at any time with reasonable notice.
4. Cancellation
You may cancel your TopTubs Monthly Bronze Subscription at any time by providing written notice. If you cancel before the end of a subscription month, you will not be charged for that month. If you cancel during a subscription month, you will be charged for that month. We reserve the right to terminate the subscription at any time with reasonable notice.
5. Access to Hot Tub and Water Supply
You agree to provide clear access to your hot tub and water supply during our visits for maintenance purposes. If access is restricted or unavailable, we will not be responsible for the inability to perform maintenance.
6. Limitation of Liability
We shall not be liable for any loss or damage arising from our provision of TopTubs Monthly Bronze Subscription, including but not limited to any loss or damage arising from any delay or failure to perform our obligations under this Agreement. You agree to indemnify us against any claims, damages, and expenses arising from your breach of this Agreement or the improper use of the hot tub.
7. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
8. Termination
We reserve the right to terminate this Agreement immediately and without notice if you fail to comply with any of the terms and conditions of this Agreement or if we determine that the hot tub is being misused or abused. Upon termination, you agree to pay any outstanding balances and return any equipment or materials that were provided by us. In the event of cancellation by either party, any prepaid fees for future visits will be refunded.
9. Equipment and Materials
We will provide all necessary equipment and materials for the maintenance of the hot tub, including cleaning supplies and chemicals. You agree to provide a safe and secure location for us to store our equipment and materials on your property. It is your responsibility to ensure that there is a safe and unobstructed path for us to access the hot tub, and to provide clear instructions for any special requirements or considerations for accessing the property.
10. Insurance
We carry liability insurance for our business activities, including the maintenance of hot tubs. However, you are responsible for obtaining and maintaining adequate insurance coverage for your property, including the hot tub, against loss, damage, or other liabilities that may arise from our activities. You agree to indemnify and hold us harmless from any claims or damages arising out of or in connection with your use of the hot tub or our provision of services, except to the extent caused by our gross negligence or willful misconduct.
11. Confidentiality
We will keep all customer information confidential and will not disclose any information about you or your hot tub to third parties without your prior consent, except as required by law. You agree to provide us with any necessary access codes or security information to enable us to perform our services, and to notify us promptly if any changes or updates are required.
12. Changes to Agreement
We may change the terms and conditions of this Agreement at any time by providing you with reasonable notice. Your continued subscription to TopTubs Monthly Bronze Subscription after the effective date of any changes will constitute your acceptance of such changes. If you do not agree to the changes, you may cancel your subscription and receive a pro-rated refund for any prepaid fees.
13. Entire Agreement
This Agreement represents the entire agreement between you and us regarding the TopTubs Monthly Bronze Subscription and supersedes all prior negotiations, understandings, and agreements between the parties, whether written or oral. Any amendments or modifications to this Agreement must be in writing and signed by both parties.
14. Notices
All notices required or permitted under this Agreement shall be in writing and shall be delivered personally, by certified mail, or by email to the addresses provided by each party. Notice shall be deemed effective upon delivery or, if sent by certified mail, on the third business day following mailing.
15. Assignment
This Agreement may not be assigned by either party without the prior written consent of the other party. Any attempt to assign this Agreement without such consent shall be null and void.
